1. Agreement to Terms
By accessing and using the services of MoverFocus ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.
MoverFocus provides international moving and relocation services to individuals and businesses. These terms govern your use of our website, services, and any related communications.
2. Services Description
MoverFocus offers the following services:
- International household goods moving via sea freight (FCL, groupage, LCL)
- Air freight services for urgent or small shipments
- Marine transit insurance facilitation
- Customs clearance coordination
- Moving consultation and advisory services
- Corporate relocation services
We act as a coordinating agent working with accredited international partners and service providers to complete your move.
2.1 Partner Referrals
In situations where we are unable to directly service your moving request due to route limitations, capacity constraints, or specialized requirements, we may refer your inquiry to TriGlobal, our trusted international moving partner. By submitting a quote request, you consent to:
- Your contact information and moving details being shared with TriGlobal
- TriGlobal contacting you directly to provide quotes and services
- Your acceptance that any services provided by TriGlobal are governed by their own terms and conditions
MoverFocus is not responsible for services provided by TriGlobal or any other partner organization. Any contractual relationship formed with a referred partner is independent of MoverFocus.
3. Quotations and Pricing
All quotations provided are estimates based on the information you supply. Final pricing may vary based on:
- Actual volume and weight of goods
- Access conditions at collection and delivery addresses
- Changes to service requirements
- Currency fluctuations and fuel surcharges
- Changes in customs duties, taxes, or regulations
Quotations are valid for 30 days from the date of issue unless otherwise stated. We will notify you of any significant price variations before proceeding.
4. Customer Responsibilities
As a customer, you are responsible for:
- Providing accurate and complete information about your shipment
- Declaring all high-value, fragile, or restricted items
- Ensuring goods are packed appropriately if self-packing
- Providing necessary documentation for customs clearance
- Being available during agreed collection and delivery timeframes
- Paying all applicable duties, taxes, and charges at destination
- Complying with all relevant laws and regulations
5. Prohibited Items
The following items are prohibited from shipment:
- Illegal drugs, weapons, and ammunition
- Hazardous materials and explosives
- Perishable food items
- Live plants and animals
- Cash, negotiable instruments, and securities
- Items prohibited by origin or destination country regulations
You are solely responsible for compliance with all customs and import regulations. MoverFocus is not liable for confiscation, delays, or penalties resulting from prohibited or restricted items.
6. Insurance
We strongly recommend comprehensive marine transit insurance for all international moves. MoverFocus facilitates insurance policies through reputable underwriters but is not the insurer.
Without insurance, our liability is limited to industry-standard carrier liability, which is typically minimal (often $2 per kilogram or less). Insurance claims are processed directly with the insurer according to policy terms.
7. Liability and Claims
MoverFocus acts as a coordination agent. Our liability is limited to:
- Our own acts or omissions in providing coordination services
- The liability of our contracted service providers as defined in their terms
- Industry-standard carrier liability in the absence of insurance
All claims must be reported in writing within 7 days of delivery for visible damage, or 14 days for concealed damage. Claims are subject to inspection and verification.
We are not liable for delays caused by customs, weather, port congestion, acts of God, or circumstances beyond our reasonable control.
8. Payment Terms
Payment terms are specified in your quotation and service agreement. Typically:
- A deposit is required to confirm booking
- Balance payment is due before or upon collection
- Destination charges are payable to our destination agent before delivery
Failure to pay may result in storage charges, delay in delivery, or legal action to recover amounts owed plus reasonable collection costs.
9. Cancellation and Refunds
Cancellation policies vary depending on the stage of your move:
- Before collection: Cancellation fees may apply based on costs already incurred
- After collection: Full charges apply as services have been rendered
- After shipping: No refund available; storage and return freight charges apply if goods are not accepted at destination
10. Force Majeure
We are not liable for failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, labor disputes, port closures, pandemics, government actions, or carrier delays.
11. Data Protection and Privacy
Your personal information is handled in accordance with our Privacy Policy and applicable data protection laws including the New Zealand Privacy Act 2020. We collect, use, and share information only as necessary to provide our services.
By submitting a quote request, you provide explicit consent for your information to be used for providing moving quotes and, if necessary, shared with our trusted partner TriGlobal in cases where we cannot service your request directly. This ensures continuity of service and maximizes your chances of receiving appropriate moving assistance.
12. Dispute Resolution
In the event of a dispute:
- Contact us in writing to attempt resolution
- If unresolved, disputes may be referred to mediation
- Legal proceedings are governed by New Zealand law and jurisdiction
13. Amendments to Terms
We reserve the right to modify these terms at any time. Updated terms will be posted on our website with the revision date. Your continued use of our services constitutes acceptance of modified terms.
